Major Disruptive Events (Force Majeure) Policy
Egy Stay is committed to fair and transparent handling of exceptional circumstances beyond the control of the parties, which may affect the ability to fulfill contractual obligations, in accordance with the following provisions:
1. Definition
“Major Disruptive Events” or “Force Majeure” refer to any exceptional event or circumstance beyond the reasonable control of the host, guest, or platform, which makes the performance of contractual obligations impossible or excessively difficult, or disrupts the normal provision of services.
2. Examples of Major Disruptive Events
These events include, but are not limited to:

Natural disasters such as earthquakes, floods, storms, fires, and landslides.

Epidemics or pandemics, including COVID-19 or similar infectious diseases.

Political or security disturbances, including wars, riots, coups, or acts of terrorism.

Governmental decisions or restrictions, such as city lockdowns, curfews, or travel suspensions.
-
Widespread and sudden outages of essential services, including electricity, internet, or water.
-
Any other extraordinary circumstances that directly prevent the performance of contractual obligations despite reasonable efforts.
3. Effect of Major Disruptive Events
In the event of a force majeure occurrence:

The affected party shall be temporarily relieved from performing its obligations for the duration of the event, without being deemed in breach of contract.

No party shall bear legal or financial liability for delays or cancellations resulting from such circumstances.

Any party may request the cancellation or modification of a booking if performance becomes impossible due to the disruptive event, subject to notifying the other party and the platform.
4. Notification Procedures

The affected party must notify Egy Stay and the other party within 48 hours of the occurrence of the event, where reasonably possible.

Supporting evidence should be provided where available, such as official statements, government orders, or reliable media reports.

The platform will review the case and determine whether the event qualifies as force majeure based on applicable legal and practical standards.
5. Settlement of Affected Bookings and Payments

In case of cancellation due to a major disruptive event, paid amounts will be handled in accordance with the platform’s applicable policy at the time, either through refunds or future credits.

Egy Stay may deduct only actual administrative or banking fees, if applicable.

No party shall be liable for indirect losses, including loss of income, profits, or future booking opportunities.
6. Parties’ Obligations During the Event

Each party must make reasonable efforts to mitigate the effects of the disruptive event and resume normal operations as soon as possible.

Egy Stay will inform users of any relevant updates or exceptional measures during such periods.
7. End of the Event
Once the disruptive circumstances cease and normal conditions resume:

Contractual obligations shall continue as they existed prior to the event.

If performance cannot be resumed for more than 30 consecutive days, any party may request termination of the agreement without additional liability.
8. General Provisions

This policy shall be interpreted in accordance with the Egyptian Civil Code and principles of fairness and equity.

Force majeure may not be invoked to avoid obligations that can reasonably be performed partially or through alternative means.

Egy Stay reserves the right to take appropriate measures to protect users and manage cancellations or compensations in a fair and transparent manner.
