Damage Compensation and Violations Policy

  1. Scope of Liability
The user, whether a tenant or a host, acknowledges that use of the “Egy Stay” platform and its services is at their own responsibility, and that they bear full responsibility for any act, damage, or violation resulting from the use or management of the rented property unit.
  2. Tenant Obligations
    • The tenant must preserve the property and all of its contents, including furniture, appliances, tools, and fixtures, in the same condition in which they were received at the beginning of the stay.
    • The tenant may not make any change or modification to the unit without the host’s prior written consent.
    • The tenant bears full responsibility for any damage or loss affecting the property or its contents as a result of misuse, negligence, or intentional acts.
    • If there is more than one tenant, all tenants shall be jointly liable for any damage occurring during the stay.
  3. Damage Assessment Procedures
In the event of a report of damage or a violation, the following steps shall apply:
  4. A formal report must be submitted through the platform within no more than 24 hours from the discovery of the damage or after the tenant’s departure.
  5. Clear evidence must be provided, such as photos, videos, or technical reports, where available.
  6. The “Egy Stay” administration shall review the report and assess the damage within no more than 7 business days.
  7. If the damage is confirmed, the compensation amount shall be deducted directly from the security deposit or from the payment method used for the booking.

• The platform reserves the right to hold funds or temporarily freeze the account until the dispute is resolved.

  1. Security Deposit
    • The host may require a refundable security deposit to be paid upon booking confirmation.
    • This amount shall be held securely by “Egy Stay” until the end of the stay and inspection of the property.
    • The deposit shall be returned within 3 to 7 business days after confirmation that there are no damages or violations.
    • If damage is confirmed, the due amount shall be deducted from the deposit. If the damage exceeds the deposit amount, the tenant must pay the difference within no more than 5 business days.
  2. Types of Damages and Violations Subject to Compensation
Compensation may apply to, including but not limited to:
    • Breakage of or damage to furniture, household items, or electrical appliances.
    • Loss of keys or access cards.
    • Damage to walls, flooring, paint, or curtains.
    • Smoking inside units where smoking is prohibited.
    • Causing disturbance to neighbors or violating property or compound regulations.
    • Using the unit for unlawful purposes or in violation of public morals.
  3. Host Obligations
    • The host must deliver the unit in a clean, fully functional condition and with all agreed contents available.
    • The host must document the condition of the property before handing it over to the tenant and after check-out in order to determine responsibility accurately.
    • The host may not claim undocumented compensation or deductions that were not reported through the platform.
  4. Role of Egy Stay
    • The platform acts as a neutral intermediary to protect the rights of both parties.
    • It evaluates complaints and claims based on the evidence submitted.
    • The platform reserves the right to settle or deduct amounts due to the affected party where a violation is proven.
    • The platform does not bear direct financial liability for damages resulting from the actions of any user, but it facilitates the compensation process in a manner that promotes fairness and transparency.
  5. Additional Penalties
    • In the event of repeated violations or submission of misleading information, “Egy Stay” may suspend or permanently terminate the account.
    • The platform may also prohibit the user from future booking or listing activity and may take the necessary legal measures in accordance with Egyptian law.
  6. Applicable Law
All compensation cases and financial claims shall be governed by the provisions of Egyptian civil law, and the courts of Cairo shall have jurisdiction in the event that an amicable resolution cannot be reached.
